Question 1

What is the correct order of the authentication chain for a NY-notarized document to be used in a non-Hague Convention country?

Answer: The chain proceeds: notary public → county clerk (certifies notary's signature) → Secretary of State (certifies county clerk's signature) → U.S. State Department (federal authentication). This full chain is required because non-Hague countries cannot accept an apostille.

Question 2

What specific function does the county clerk perform in the NY document authentication process?

Answer: The county clerk certifies the notary's signature and confirms the notary's authority to act within that county. This certification is an essential first step in the authentication chain before the document can be further certified for out-of-state or international use.

Question 3

How does the authentication process differ for NY documents destined for a country that is NOT a member of the Hague Convention?

Answer: Non-Hague countries cannot accept an apostille, so the full authentication chain is required: notary → county clerk → Secretary of State → U.S. State Department (federal authentication). The destination country may also require legalization by its embassy or consulate.

Question 4

What is an apostille, and which NY office is authorized to issue it?

Answer: An apostille is a specialized international certification issued under the Hague Convention that authenticates the origin of a public document for use in member countries. In New York, the Secretary of State is authorized to issue apostilles on NY-notarized documents.

Question 5

What is a certificate of official character in New York, and who issues it?

Answer: A certificate of official character is issued by the county clerk to certify that a notary public is duly qualified and authorized to perform notarial acts. It confirms the notary's signature and official standing within that county.
